Terms of Service — Lipsy

1. Acceptance of These Terms

By downloading, installing, or using the Lipsy mobile application (“Lipsy”, “we”, “our”, or “us”), you (“User”, “you”, or “your”) agree to be bound by these Terms of Service (“Terms”). If you do not agree with these Terms, do not use Lipsy.

2. Eligibility

You must be at least 4 years old (or the minimum age of digital consent in your jurisdiction) to use Lipsy.

3. License Grant

We grant you a limited, non-transferable, revocable, and non-exclusive license to use Lipsy for personal, non-commercial purposes in accordance with these Terms. All rights not expressly granted remain with us and our licensors.

4. User Content

Ownership — You retain all rights to the images and content (“User Content”) you upload.

Processing License — You grant Lipsy a temporary, worldwide, royalty-free license to process your content strictly to provide lip filler simulation and lip enhancement visualization features. The license terminates after processing, and your data is deleted in line with our Privacy Policy.

Responsibility — You are solely responsible for your content and ensure it does not infringe on any laws or third-party rights. You must not upload photos of other people without their consent.

5. Subscriptions & Purchases

Subscriptions — Lipsy offers optional subscription plans that unlock premium features such as unlimited simulations and access to all lip styles, including Russian lips, lip flip, and volume-based looks.

In-App Purchases — Subscriptions are sold through Apple's in-app purchase system. Apple handles all payments, taxes, and billing.

Renewal & Cancellation — Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription through your Apple ID settings. Refunds are subject to Apple's policies.

6. Prohibited Conduct

You agree not to:

• Upload or use offensive, illegal, or harmful content.
• Upload photos of other people without their consent.
• Violate any applicable law.
• Reverse-engineer, modify, or exploit Lipsy's technology.
• Use bots or scripts to abuse the system.
• Share or sell generated images or services without our permission.

We reserve the right to impose restrictions in cases of abnormal or abusive usage (e.g., nonstop automated photo submissions intended to overload the system).

7. Medical Disclaimer

Lipsy is not a medical or cosmetic treatment service. The Application does not provide medical diagnoses, treatment, or professional aesthetic advice. The AI-powered lip filler simulations are intended purely for informational and illustrative purposes, to help users visualize potential aesthetic changes.

If you are considering lip filler or any other cosmetic procedure, you should always consult with a licensed medical practitioner or qualified aesthetic professional. Lipsy is not intended for use in emergencies, medical decision-making, or as a substitute for professional consultation.

The informational and illustrative content within Lipsy is inspired by publicly available medical and aesthetic guidelines from internationally recognized institutions, including:

9. Intellectual Property

All content in the Lipsy app (logos, code, UI, designs, text, and graphics) belongs to Lipsy or its licensors. You may not use them for commercial purposes without permission. Any feedback or suggestions you provide can be used freely by us without compensation.

10. Privacy

Your privacy is important. Please read our Privacy Policy to understand how we collect, use, and protect your data. It forms part of these Terms.

11. Disclaimers

Lipsy is provided “as is” and “as available”. We do not guarantee that lip simulation results will meet your expectations. Results are illustrative only and may vary based on photo quality, lighting, and facial anatomy, and they do not predict the outcome of any real cosmetic procedure. We are not responsible for content loss or damage.

If you use the Application outside of a Wi-Fi area, your mobile provider's terms still apply and you may incur data or roaming charges. It is your responsibility to manage these costs.

12. Limitation of Liability

To the fullest extent allowed by law, Lipsy shall not be liable for any indirect, incidental, or consequential damages. Our total liability for any claim shall not exceed 50 EUR.

13. Indemnification

You agree to indemnify and hold harmless Lipsy, its affiliates, and staff from any claims or damages arising out of your use of the app or violation of these Terms.

14. Termination

By You — You may stop using Lipsy at any time.

By Us — We may suspend or terminate your access if you violate these Terms or misuse the app.

Effect — Certain clauses (Intellectual Property, Disclaimers, Liability) will survive termination.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of Türkiye. You agree to resolve any disputes through the courts of Türkiye, unless local consumer protection laws offer you additional rights.

16. Changes to the Terms

We may update these Terms at any time. Continued use of Lipsy after the effective date means you accept the changes.

17. Miscellaneous

These Terms and the Privacy Policy form the entire agreement between you and Lipsy. If any part is found invalid, the rest remains enforceable. You may not transfer these Terms without our permission.
